Professor Berman said, “The DC Circuit panel unanimously and forcefully rejected Trump's far-fetched claims of absolute presidential immunity from criminal prosecution. The key question now is whether the Supreme Court, if it grants review, expedites the case so that a trial is possible before the November election.”

In particular to this news, Morrison said, “Now that former President Trump has had a full appeal and the court of appeals has unanimously rejected his absolute immunity claims, Special Counsel Smith should immediately move to lift the stay in the district court and Trump should have to obtain a further stay from the Supreme Court, which should reject his defense without hearing argument.”
