Media Tip Sheet: Legal Questioning of Global Tariffs

WASHINGTON (January 7, 2025) – On Friday, the Supreme Court may rule on the legality of President Trump’s global tariffs. Arguments from November 5 indicate the court is skeptical of Trump's authority to impose tariffs under a 1977 law that gives the president special powers during emergency situations.

Alan B. Morrison is the Lerner Family Associate Dean for Public Interest and Public Service at GW Law, where he teaches civil procedure and constitutional law. Morrison has been directly involved in the litigation over Trump's tariffs and filed a brief on behalf of Consumer Watchdog in those cases arguing that, even if IEEPA authorized the use of tariffs, they  would be unconstitutional given IEEPA's unconstitutional delegation of legislative power to the President.
